Law Offices of
Sterling Rauf, Esq. - FAQ's
Q: Why should I fight a NJ DWI
/ DUI charge against me?
A: The consequences of a DWI / DUI conviction are severe. Loss
of license is compulsory. The fines are high. Insurance
surcharges are extreme, and insurance rates will go up. There
may be other consequences. For example, having a DWI / DUI on
your record may hurt you when you apply for jobs, college or
even traveling abroad.
Q: Will I be able to get a
plea bargain?
A: No. Plea bargaining is not available for DWI / DUI offenses
in NJ; which means a mandatory loss of license on every
conviction. That is why it is so important to have an
experienced DWI / DUI lawyer carefully examine all the
evidence against you to make sure that you can fight the DWI /
DUI charges. Don’t even think about pleading guilty to
charges before an experienced DWI /
DUI lawyer
like Sterling Rauf, Esquire has had an opportunity to review
all the evidence and advise you.
Q: Do I need a DWI / DUI lawyer?
A: No, you don't "need" a lawyer at all. If you want
to plead guilty to the charge you do not need a lawyer.
However, you will most likely not know the law sufficiently to
be able to see the “holes’ in the prosecution’s case.
For example, you will not know whether your constitutional
rights have been infringed when the police stopped you and you
will not know how to review the discovery which will reveal
whether the breathalyzer was working properly, or the blood
samples were properly taken. Or in fact whether the camera
equipment on the police officer’s car shows that your
performance on the field sobriety test was different to the
results shown on the prosecutor’s written reports.
Q: Do I have to appear in court?
A: Yes. You must always appear in court on DWI / DUI charges,
even if you intend asking for a postponement to obtain
documents and police reports.
Q: What DWI / DUI courts do
you cover?
A: We handle DWI / DUI Law in all courts in the State of New
Jersey. We are willing to travel to any court in the State of
New Jersey.
Q: Will my insurance rates go up if I am convicted?
A: Almost certainly. A DWI / DUI conviction is reported on
your New Jersey driving record. In some cases your insurance
company will drop you as a customer. You will also have very
high insurance surcharges; $3,000 over 3 years for first and
second convictions, and $4,500 over 3 years for a third
conviction.
Q: Can I beat a DWI / DUI charge?
A: Whether you can obtain a dismissal, or an acquittal depends
on the evidence against you. The police may not have had a
good reason to stop your car. They may not have had enough
evidence to require a BAC test. They may have performed the
tests wrong. You may have credible witnesses who can say you
were not intoxicated. Only an experienced DWI / DUI attorney
like Sterling Rauf, Esq., has the knowledge and experience
gained over 30 years of law practice in the United States and
England to know how to examine the evidence. You should go
over the facts of your case with an experienced DWI / DUI
lawyer. Sterling Rauf Esq., has the experience you need.
Q: What do you charge?
A: Our fees are both fair and reasonable. They are affordable.
